Guaranteed Home Warranty Contract

It’s easy to submit a claim – just visit www.realhomewarranty.com and fill in the submit a claim form.
You will need the subject property street address, policy owner contact information for the form and you must upload a copy of the repair invoice at the time of the claim. A $60 service payment fee will be deducted from the policy amount for each claim placed.

IMPORTANT NOTICE
Coverage is only provided for repairs that are reported to Real Home Warranty LLC during the term of this contract. You must place any claim prior to the expiration of this contract. Real Home Warranty will not pay claims if the repair was not performed by a licensed contractor or claims made after the expiration of this contract. If a claim is made after expiration, the claim will not be paid unless the policy owner can show that it was not reasonably possible to submit the claim within the 12-month warranty period. If a repair has been done and the cost is greater than the amount of the policy balance, the difference in cost of the repair must be paid by the policy owner.

We may use the policy owner’s personal contact information provided for setting up and processing the warranty. We may also use this contact information for communicating with policy owner about their account activities and events for marketing purposes (such as providing special offers, additional coverage options and renewal programs). Policy owner may opt out of receiving emails at any time by calling us at 801-784-0749.

COVERAGE TIMELINE
Buyer’s coverage starts once payment is received from the closing date of the home and will continue for one year from the closing. Coverage is limited to the purchase amount of the warranty.
Payment is due at the close of the sale and must be received by Real Home Warranty LLC within 30 days of the close of sale.
Real Home Warranty will send payment for any home repair, appliance or HVAC repair, performed by a licensed professional, not to exceed the total amount of the warranty cost within a year.

BASIC CONTRACT COVERAGE
The following items are covered by this contract once payment is received by REAL Home Warranty at the close of sale. It is very important to read through the Limits of Liability.

PLUMBING  – PLUMBING STOPPAGES – HEATING – GARAGE DOOR – ELECTRICAL – DUCT WORK – WATER HEATER – AIR CONDITIONING UNIT – *FURNACE – KITCHEN REFRIGERATOR – WASHER AND DRYER – SEPTIC TANK – BUILT IN MICROWAVE – TRASH COMPACTOR – INCLUDING PREEXISTING CONDITIONS
This warranty does not include personal property in its coverage.

LIMITS OF LIABILITY
Common areas and facilities of condominiums and trailer parks and not covered.
This coverage is for single family properties only. There is no coverage for multi-family, dwellings of 2 units or more or for commercial properties.
Repairs or replacements due to vandalism, acts of God, war, mud, earthquake, fire, storms, lightning, flood, or smoke are not covered by this contract.
The company is not liable or responsible for the service provider, personal property, living expenses, utility bills or loss of income.
The company will not be liable or responsible for any costs related to building permits or carpentry work including cabinets, counter-tops, flooring, wall coverings, paint or personal property.
The company is not responsible for repair or replacement of items that are covered under a manufacturer’s warranty.
*The furnace is covered within the one year time frame on policy plans of $500 or more, and policies must have min $500 remaining balance. The policy owner must submit a copy of their professional home inspection report, which must state that the furnace and heat exchange were in proper working order when the home was purchased. The maximum payout for a furnace is $1,500.
The company will not be liable or responsible for routine maintenance.
This service contract or warranty is subject to limited regulation by the Utah Insurance Department. To file a complaint, contact the Utah Insurance Department.
Coverage afforded under this contract is not guaranteed by the Property and Casualty Guaranty Association.

IMPORTANT
Once the claim amounts have reached the dollar amount of the warranty purchased, the warranty will have reached its maximum amount of repair costs and will no longer be valid.  If the available policy balance is less than the $60 service fee payment, the policy owner may make a final claim up to 50% of the available balance without a service fee payment.

CUSTOMER SERVICE
In the event of a needed repair service, please contact a licensed professional of your choice to perform the necessary repairs.

Once the repairs have been completed, please visit our website www.realhomewarranty.com to submit the claim. Complete the Submit A Claim form and upload the invoice.

All payments to licensed professionals must be done through Real Home Warranty LLC. If the licensed professional requires payment at the time of service, upload the receipt to www.realhomewarranty.com and the amount paid will be reimbursed to the warranty owner not to exceed the policy amount purchased. There will still be a $60 service fee taken out of the amount of warranty coverage.

Once the repair claim with invoice is received by Real Home Warranty the payment to the licensed professional or reimbursement to the policy owner will be mailed within 7 business days. 
Repair claim payments will be made up to the amount of the warranty’s balance less a $60 service payment fee not to exceed the policy amount purchased. 

EMERGENCY REPAIRS
Real Home Warranty LLC does not provide or recommend licensed contractors with regard to repairs. The owner of the warranty must contact their own preferred licensed professional to schedule / perform needed repairs. Real Home Warranty LLC does not schedule any repairs with the licensed professional. If there is an emergency that is after hours, simply contact the licensed professionals’ emergency or after-hours number.

TRANSFER OF CONTRACT
There is no transfer of the contract to any other party.

CANCELLATION
The home service contract is non-cancellable by the company during the one-year term of the warranty with the exception of nonpayment, or once the full amount of the warranty has been used. If the company cancels the contract for nonpayment of contract fees, a notification will be mailed to the customer within 10 business days. This contract is non-cancelable by the policy owner.

PAYMENT TERMS
The following are acceptable payment terms: Money order, check or credit card.

WARRANTY COVERAGE DOLLAR LIMITATIONS
We provide the ultimate flexibility. You choose the coverage level up to $4,000.

UNUSED WARRANTY REBATE POLICY
In the event the customer has not made a claim by the expiration of the warranty, the customer may request a rebate of 50% of the policy coverage amount up to $200. Rebates are available for a 30 day timeframe after the expiration of the policy. Rebates are claimed by submitting a written rebate request to Real Home Warranty, 579 Heritage Park Blvd #201, Layton UT 84041.

ARBITRATION
ANY MATTER IN DISPUTE BETWEEN YOU AND THE COMPANY MAY BE SUBJECT TO ARBITRATION AS AN ALTERNATIVE TO COURT ACTION PURSUANT TO THE RULES OF (THE AMERICAN ARBITRATION ASSOCIATION OR OTHER RECOGNIZED ARBITRATOR), A COPY OF WHICH IS AVAILABLE ON REQUEST FROM THE COMPANY. ANY DECISION REACHED BY ARBITRATION SHALL BE BINDING UPON BOTH YOU AND THE COMPANY. THE ARBITRATION AWARD MAY INCLUDE ATTORNEY’S FEES IF ALLOWED BY STATE LAW AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF PROPER JURISDICTION.
All disputes and claims arising out of or relation to this contract must be resolved by binding arbitration. This agreement to arbitrate includes but is not limited to: all disputes and claims between Real Home Warranty and the Homeowner, Real Home Warranty and the Seller, and claims that arose prior to the purchase of the warranty. This agreement to arbitrate applies to Real Home Warranty, Homeowner and Seller, and their respective parent and subsidiary companies, affiliates, agents, employees, predecessors and successors in interest, assigns, heirs, spouses and children.
The arbitration must take place on an individual basis and all parties involved agree that they are waiving any right to a jury trial. And further agreeing not to bring or participate in a class, representative or private attorney general action. The arbitrator lacks the power to consider claims for injunctive or declaratory relief or to gran relief effecting anyone other than the individual claimant.
The arbitration is governed by the Commercial Arbitration Rules and the Supplementary Procedures for the Consumer Related Disputes of the American Arbitration Association (AAA) as modified by this agreement and will be administered by the AAA. Real Home Warranty will pay all filing, administration and arbitrator fees for an arbitration it initiates and for any arbitration initiated by another party for which the value of the claim is $10,000 or less. Unless an arbitrator determines that the claims have been brought in bad faith or for an improper purpose. The arbitration award may include attorney’s fees if allowed by federal, state or other applicable laws and may be entered as a judgment in any court of proper jurisdiction.
The arbitration must take place in the sale county in which the property covered by the home warranty contract is located, The Federal Arbitration Act will govern the interpretation, applicability and enforcement of this arbitration agreement. The arbitration agreement will survive the termination of this home warranty contract. Notwithstanding this arbitration agreement, any party may, if it prefers, bring an individual action in small claims court.
